Refunds and defaults
Liability for breach of contract by the travel agency
1. If the travel agency proposes to terminate the contract within 7 days before the start of the trip, or if the traveler receives the travel agency's notice of not being able to make the tour within 7 days before the start of the trip, and does not agree to transfer to another tour, postpone the trip and change the route to terminate the contract, the travel agency will refund all the travel expenses it has charged to the traveler, and will pay the liquidated damages to the traveler in accordance with the following standards:
From 6 to 4 days before the start of the trip, 10% of the total amount of travel expenses shall be paid as liquidated damages;
From 3 to 1 days before the start of the trip, 15% of the total amount of the tour price;
20% of the total tour price on the day the tour starts.
If the liquidated damages paid in the above proportion are not enough to compensate the actual loss of the traveler, the travel agency shall compensate the traveler according to the actual loss.
The travel agent shall, within 5 working days from the date of arrival of the notice of cancellation of the tour or the notice of termination of the contract in which the traveler does not agree with the arrangement of not forming a tour, complete the formalities of refunding all the travel expenses for the traveler and pay the liquidated damages mentioned above.
2. If the travel agency fails to provide services as agreed in the contract, or adjusts the tour itinerary without the consent of the tourists (except for the cases stipulated in paragraph 3 of Article 9 of this contract), which results in the reduction of the program, the shortening of the tour time, or the lowering of the standard, the travel agency shall bear the responsibility of continuing to fulfill the contract, taking remedial measures, or compensating for the losses and other breach of contract in accordance with the law.
3. If the travel agency has the conditions for fulfillment and still refuses to fulfill the obligations under this contract upon the request of the traveler, the travel agency shall pay to the traveler 30% of the total amount of travel expenses as liquidated damages, and the traveler shall take remedial measures such as booking the same level of accommodations, meals, and transportation at the travel agency's expense; and if it causes the traveler's personal damages, detention and other serious consequences, the traveler may also request the travel agency to pay the amount of compensation which is more than double and more than three times of the total amount of travel expenses. The traveler can also ask the travel agency to pay more than one and three times of the travel expenses as compensation.

(1) The travel agency organizes tourism activities at an unreasonably low price, lures tourists, and obtains improper benefits such as kickbacks by arranging shopping or separately paid tourism projects;
(2) The travel agency designates specific shopping places or arranges separately paid tourist programs without mutual consensus or without the request of the tourists.
6. In case of disputes with the tourists, the travel agency shall take positive measures to prevent the losses from expanding, otherwise it shall be liable for the expanded losses.
Liability of tourists for breach of contract
1、Travelers who affect the group's itinerary because they do not listen to the advice and tips of the travel agency and its tour guide, and cause losses to the travel agency, shall bear the corresponding compensation responsibility.
2. The tourists shall bear the losses caused by their personal activities beyond the content of this contract.
3、The traveler shall compensate for the damage suffered by the travel agency, performance support person, tourism staff or other travelers due to the fault of the traveler.
4、The tourists shall take measures to prevent the losses from expanding in the tourism activities or in the settlement of disputes, otherwise they shall bear the corresponding responsibility for the expanded losses.
5、Tourists who violate the provisions of safety warning, or do not cooperate with the national measures to cope with major emergencies temporarily restricting tourism activities, safety precautions and emergency measures, resulting in losses of the travel agency, shall bear the corresponding responsibility in accordance with the law.
Other responsibilities
1. The travel agency shall not be liable for any failure to fulfill this contract or any failure to fulfill it in accordance with the agreement due to the traveler's own reasons, or for any personal damage or property loss caused to the traveler.
2. If the traveler's personal or property rights and interests are harmed during the self-arranged activities, the travel agent shall not be liable for compensation if the travel agent has already fulfilled the necessary warning and explanation obligations beforehand and the travel agent has already fulfilled the necessary rescue obligations afterwards.
3. If the traveler's personal and property rights and interests are harmed due to a third party's infringement or other reasons not attributable to the travel agency, the travel agency shall not be liable for compensation. However, if the travel agency fails to fulfill its obligation to assist the tourists in expanding the loss of their personal and property rights and interests, the travel agency shall be liable for the expanded loss.
4. If the traveler is liable for personal injury or property loss caused by the public transportation operator, the travel agency shall assist the traveler in claiming compensation from the public transportation operator.
